Welcome to CelinieJourney. These Terms & Conditions ("Terms") govern your access to and use of the CelinieJourney website, online store, products, customer account features, appointment tools, content, forms, checkout, and related services (collectively, the "Services"). The terms "CelinieJourney," "we," "us," and "our" refer to CelinieJourney. The terms "you" and "your" refer to any customer, visitor, account holder, purchaser, recipient, or other person who accesses or uses the Services.

Our online store is powered by Shopify Inc. ("Shopify"), which provides the ecommerce platform, checkout, payment, customer account, and related technology that allows us to offer products and Services to you. Purchases made through our store are transactions between you and CelinieJourney, not between you and Shopify.

Please read these Terms carefully before using the Services or placing an order. By visiting our website, creating or using an account, placing an order, submitting a form, requesting an appointment, contacting us, or otherwise using the Services, you agree to be bound by these Terms, our Privacy Policy, and any other policies referenced in these Terms. If you do not agree, you should not access or use the Services.

1. Eligibility and Use of the Services

By using the Services, you represent that you are at least the age of majority in your state, province, or place of residence, or that you are using the Services with the involvement and consent of a parent or legal guardian.

You agree to use the Services only for lawful, personal, household, or gift-related shopping purposes. You may not use the Services for unauthorized resale, unlawful export, fraudulent activity, commercial scraping, data extraction, abuse of forms or checkout, or any activity that interferes with the normal operation of the Services.

2. Customer Accounts

You may be able to create or access a customer account through Shopify-powered account features. You agree that all information you provide to CelinieJourney or through Shopify account tools is accurate, current, complete, and provided with proper authorization.

You are responsible for maintaining the confidentiality of your account login information and for all activity that occurs through your account. Please contact us promptly if you believe your account, order information, or login access has been used without authorization.

We may suspend, restrict, or terminate account access where permitted by law, including if we believe an account has been used for fraud, abuse, unauthorized resale, policy violations, security risks, or activity that may harm CelinieJourney, Shopify, customers, or third parties.

3. Product Information and Jewelry Descriptions

We make reasonable efforts to display and describe our jewelry, materials, stones, colors, sizes, finishes, measurements, prices, and availability accurately. However, product images, colors, sparkle, scale, metal tone, stone appearance, and finish may vary depending on photography, lighting, screen settings, styling, production differences, and the way an item is worn.

Measurements, dimensions, stone sizes, carat equivalents, chain lengths, ring sizes, weights, and similar product details may be approximate unless expressly stated otherwise. Product descriptions are provided for shopping information and should not be treated as appraisal, investment, medical, legal, or professional advice.

Laboratory-grown gemstones, moissanite, cubic zirconia, sterling silver, plated finishes, recycled materials, and other materials may be described according to supplier information, product specifications, and our internal product review. We may update product descriptions, product details, materials, care instructions, images, prices, and availability at any time.

4. Product Availability and Limits

Products and services are offered subject to availability. We may limit quantities, discontinue products, restrict sales by person, household, order, geographic region, or jurisdiction, or decline orders where permitted by law.

We do not guarantee that any product, size, color, stone option, finish, promotion, price, or service will remain available. If an item becomes unavailable after you place an order, we may contact you to discuss available options, such as waiting for availability, selecting an alternative item, store credit where applicable, or refunding the unavailable portion of the order.

5. Orders and Order Acceptance

When you place an order, you are making an offer to purchase the selected products. Receipt of an order confirmation, checkout confirmation, or payment authorization does not mean that your order has been accepted. An order is accepted when we process and fulfill it, unless we notify you otherwise.

We reserve the right to accept, decline, cancel, limit, hold, or modify any order for any lawful reason, including suspected fraud, payment issues, inventory issues, shipping restrictions, pricing or product errors, inaccurate customer information, unusual order activity, policy violations, or system errors.

If we cancel an order after payment has been collected, we will process any applicable refund to the original payment method according to Shopify, payment provider, and banking procedures. Processing times may vary by payment provider and financial institution.

6. Prices, Taxes, and Payment

Prices, discounts, promotions, offers, and product availability are subject to change without notice. The price charged for a product will generally be the price shown at checkout at the time your order is placed, subject to our right to correct errors and cancel orders as described in these Terms.

Unless otherwise stated, prices do not include applicable taxes, duties, customs charges, import fees, or other government charges. Sales tax and other applicable charges may be calculated at checkout based on Shopify settings, tax rules, delivery address, billing address, product type, and applicable law.

You agree to provide current, complete, and accurate billing, payment, shipping, and account information. You represent that you are authorized to use the selected payment method and that charges incurred by you will be honored by your payment provider.

Accepted payment methods may include credit cards, debit cards, Shop Pay, Shop Pay Installments where available, PayPal, Amazon Pay, Apple Pay, Google Pay, and other payment methods shown at checkout. Payment options may vary by device, browser, location, order value, eligibility, payment provider rules, and Shopify settings. More information is available on our Payment Options page.

7. Installment, Wallet, and Third-Party Payment Services

Some payment options, including installment, wallet, or third-party payment services, may be offered by independent payment providers. These providers may set their own eligibility requirements, approval criteria, payment schedules, fees, disclosures, privacy practices, and terms.

CelinieJourney does not control third-party payment approval decisions. If you use a third-party payment service, your relationship with that provider may be governed by separate terms and policies in addition to these Terms.

8. Promotions, Discounts, Gifts, and Store Credit

Promotions, discount codes, sale prices, gifts with purchase, bundle offers, store credit, and other special offers may be subject to separate terms, exclusions, expiration dates, minimum purchase amounts, product limitations, order limits, or other conditions. Unless stated otherwise, promotions cannot be combined, applied retroactively, exchanged for cash, transferred, or used after expiration.

If an order is returned, exchanged, canceled, adjusted, or found ineligible for a promotion, any related discount, gift, bundle benefit, or store credit may be adjusted, canceled, deducted from a refund, or handled according to the promotional terms and our posted policies.

9. Shipping and Delivery

Shipping and delivery are governed by our shipping policies. CelinieJourney currently offers shipping according to the terms described on our Free Shipping page and related shipping information pages.

Processing times, shipping times, delivery windows, delivery dates, and tracking updates are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, weather, address issues, delivery restrictions, customs processing, holidays, service interruptions, payment reviews, fraud reviews, security reviews, force majeure events, or circumstances outside our reasonable control.

You are responsible for providing a complete and accurate shipping address before submitting an order. If an order is delayed, returned, misdelivered, or lost because of an incorrect or incomplete address provided by the customer, responsibility may remain with the customer to the extent permitted by law and our posted policies.

If an order cannot be fulfilled or shipped within the expected timeframe, we may contact you with available options where required or appropriate, such as continuing with the order, selecting an alternative item, or canceling the affected item for a refund.

10. Returns, Exchanges, and Cancellations

Returns, exchanges, cancellations, return authorization, return shipping responsibility, inspection standards, refund timing, and related conditions are governed by our 30-Day Returns & Exchanges policy and any order-specific instructions we provide.

Return authorization does not guarantee a refund, exchange, store credit, replacement, or other resolution. Final approval is issued after we receive and inspect the returned item, where applicable. Items must meet our posted eligibility requirements, including timing, condition, packaging, authorization, and documentation requirements.

Unauthorized returns may be refused, delayed, returned to sender, or handled according to our posted returns policy. Customers are responsible for securely packaging return shipments. CelinieJourney is not responsible for lost or damaged return shipments sent with a customer-selected carrier.

If a return or exchange is requested for a customer preference reason, the customer may be responsible for return shipping costs. If a return or exchange is required because of an issue caused by CelinieJourney, we will provide instructions and may help cover approved return shipping according to our posted policy.

11. Warranty and Product Service

CelinieJourney may offer limited warranty coverage for eligible products according to the terms described in our Free 2-Year Limited Warranty. Warranty coverage is limited and does not apply to all forms of damage, wear, misuse, loss, improper care, third-party modifications, or customer-caused issues.

Warranty authorization does not guarantee free service, replacement, store credit, refund, or any specific outcome. Final approval is issued after review and, where applicable, inspection. Please review the warranty page for eligibility requirements, exclusions, claim instructions, shipping responsibility, inspection timing, and available resolutions.

12. Product Care and Safety

Jewelry should be worn, stored, and cared for properly. Products may be damaged by impact, pulling, bending, chemicals, water exposure, improper cleaning, improper storage, daily wear, or use during activities such as swimming, bathing, exercising, sleeping, or cleaning.

Customers with known metal, plating, stone, adhesive, or material sensitivities should review product details carefully and contact us before purchasing if they have questions. Jewelry may contain small parts and should be kept away from young children and pets. More information is available on our Product Safety page.

13. Customer Communications

By placing an order, creating an account, submitting a form, requesting an appointment, or contacting us, you agree that we may contact you using the email address, phone number, billing address, shipping address, or other contact details you provide for service-related purposes. These may include order confirmations, shipping updates, appointment messages, account notices, support replies, return or warranty communications, fraud-prevention checks, and policy notices.

If you opt in to marketing communications, we may send promotional emails or messages where permitted by law. You may unsubscribe from promotional emails by using the unsubscribe link in the email. Even if you opt out of marketing communications, we may still send non-promotional messages relating to orders, accounts, customer service requests, or legal obligations.

14. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, disclose, retain, and protect personal information. Because our store is powered by Shopify, Shopify may also collect and process certain personal information in connection with your use of the Services, checkout, payments, customer accounts, and platform features.

15. Reviews, Feedback, and User Content

If you submit reviews, photos, videos, comments, ideas, suggestions, feedback, messages, product issue documentation, or other content to us or through the Services ("User Content"), you represent that you own or have the necessary rights to provide that User Content and that it does not violate any law or the rights of any third party.

To the extent permitted by law, you grant CelinieJourney a worldwide, royalty-free, transferable, sublicensable license to use, reproduce, display, publish, distribute, adapt, and otherwise use your User Content in connection with operating, improving, promoting, and providing the Services. We are not required to keep User Content confidential, pay compensation for it, or respond to it.

We may review, edit, remove, reject, or decline to publish User Content that we determine is unlawful, misleading, offensive, abusive, defamatory, infringing, promotional, spam, irrelevant, false, harmful, or otherwise inconsistent with these Terms or our standards.

16. Intellectual Property

The Services, including our website design, text, product descriptions, images, graphics, videos, logos, names, trademarks, service marks, icons, page layouts, button designs, software, code, features, and other content, are owned by CelinieJourney, our licensors, Shopify, or other third parties and are protected by copyright, trademark, trade dress, and other intellectual property laws.

You may use the Services only for personal, non-commercial shopping and informational purposes. You may not copy, reproduce, distribute, modify, publish, display, perform, transmit, scrape, extract, sell, resell, exploit, or create derivative works from any part of the Services without our prior written permission, except as permitted by applicable law.

CelinieJourney names, logos, product names, service names, graphics, designs, and slogans may be trademarks or trade dress of CelinieJourney. Shopify names, logos, and marks belong to Shopify. 17. Third-Party Tools, Apps, and Links

The Services may include or link to third-party tools, applications, payment services, shipping services, tracking tools, social media features, customer account features, analytics services, advertising platforms, or external websites. These third-party services may be operated by parties that are not controlled by CelinieJourney.

We provide access to third-party tools and links for convenience. Such tools may be provided "as is" and "as available." We do not control and are not responsible for third-party content, terms, privacy practices, security, availability, accuracy, products, or services. Your use of third-party services is at your own risk and may be governed by separate terms and policies from those third parties.

18. Prohibited Uses

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:

  • For any unlawful, fraudulent, harmful, abusive, or malicious purpose.
  • To violate any federal, state, local, international, or other applicable law or regulation.
  • To infringe, misappropriate, or violate the intellectual property, privacy, publicity, or other rights of CelinieJourney or any third party.
  • To submit false, misleading, inaccurate, unauthorized, or deceptive information.
  • To impersonate any person or entity or misrepresent your identity or affiliation.
  • To harass, threaten, abuse, defame, intimidate, or harm any person.
  • To transmit viruses, malware, code, files, or programs designed to interfere with the Services or any systems.
  • To send spam, phishing messages, unsolicited advertising, chain letters, or other unauthorized communications.
  • To scrape, crawl, extract, copy, harvest, or collect data from the Services without authorization.
  • To bypass, disable, interfere with, or circumvent security, fraud-prevention, checkout, account, CAPTCHA, bot-detection, rate-limiting, or access-control features.
  • To use automated systems, bots, scripts, AI agents, software agents, or similar tools in a way that interferes with or abuses the Services.
  • To purchase products for unauthorized resale, export, diversion, or other commercial misuse.

We may suspend, restrict, block, or terminate access to the Services or customer accounts if we believe these Terms have been violated or if we need to protect the Services, our business, Shopify, customers, or third parties.

19. Counterfeit, Unauthorized Sellers, and Resale

Products sold through our official website are intended to be genuine CelinieJourney products. We cannot verify products purchased from unauthorized sellers, imitation websites, third-party marketplaces, resale platforms, or social media accounts that are not operated or authorized by CelinieJourney.

Returns, exchanges, warranty service, refunds, store credit, and customer support may be unavailable for products that cannot be verified as genuine CelinieJourney purchases. More information is available on our Counterfeit Warning Policy.

20. Relationship with Shopify

CelinieJourney is powered by Shopify, which enables us to provide the Services to you. However, sales and purchases made through our store are made directly with CelinieJourney. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and CelinieJourney, including any product issue, order issue, delivery issue, return issue, warranty issue, injury, damage, loss, or dispute relating to products purchased from CelinieJourney.

To the fullest extent permitted by law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or relating to your purchases, orders, product use, or transactions with CelinieJourney.

21. Disclaimer of Warranties

The Services and all information, content, features, tools, and materials made available through the Services are provided for general informational and shopping purposes. We do not guarantee that the Services will be uninterrupted, secure, error-free, accurate, complete, current, or available at all times.

Except for any express written warranty provided by CelinieJourney, including any applicable limited warranty described on our Warranty page, the Services and products are provided "as is" and "as available" to the fullest extent permitted by law, without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, durability, or quiet enjoyment.

Some jurisdictions do not allow certain warranty disclaimers or limitations, so some of the above limitations may not apply to you.

22. Limitation of Liability

To the fullest extent permitted by law, CelinieJourney, Shopify, and our respective affiliates, officers, directors, employees, contractors, service providers, licensors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, loss of data, loss of goodwill, replacement costs, business interruption, or similar damages arising from or related to your use of the Services or products purchased through the Services.

To the fullest extent permitted by law, our total liability for any claim arising from or relating to the Services or products purchased through the Services will not exceed the amount you paid to CelinieJourney for the product or transaction giving rise to the claim.

Nothing in these Terms is intended to limit liability that cannot be limited under applicable law.

23. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless CelinieJourney, Shopify, and our respective affiliates, officers, directors, employees, contractors, service providers, licensors, and agents from and against any claims, losses, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to your violation of these Terms, misuse of the Services, violation of law, User Content, violation of third-party rights, or unauthorized use of another person's account or information.

24. Termination

We may suspend, restrict, or terminate your access to the Services or any account at any time, with or without notice, where permitted by law, including if we believe you have violated these Terms, created risk for CelinieJourney, Shopify, customers, or third parties, or engaged in fraudulent, abusive, unlawful, or harmful activity.

Termination does not affect obligations or liabilities incurred before termination. Provisions that by their nature should survive termination will continue to apply, including provisions relating to intellectual property, user content, prohibited uses, disclaimers, limitation of liability, indemnification, governing law, dispute-related provisions, and privacy.

25. Governing Law

These Terms and any separate agreements by which we provide Services to you are governed by the laws of the State of Ohio and applicable United States federal law, without regard to conflict of law principles, except where applicable law requires otherwise.

To the extent permitted by law, you and CelinieJourney consent to the jurisdiction and venue of the state and federal courts located in Ohio for disputes arising from or relating to these Terms or the Services.

26. Policy Conflicts and Consumer Rights

These Terms work together with the other policies posted on our website. If a more specific CelinieJourney policy applies to a particular issue, that specific policy may control for that issue. Nothing in these Terms is intended to limit rights that cannot be limited under applicable law.

27. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law and the unenforceable portion will be deemed severed from these Terms. The remaining provisions will remain in full force and effect.

28. Waiver and Entire Agreement

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms, together with our posted policies and any terms expressly referenced in these Terms, constitute the entire agreement between you and CelinieJourney regarding your use of the Services and supersede any prior or contemporaneous communications or agreements relating to the Services.

29. Assignment

You may not assign, transfer, or delegate these Terms or your rights or obligations under these Terms without our prior written consent. We may assign, transfer, or delegate these Terms and our rights and obligations without your consent or notice, including in connection with a merger, acquisition, restructuring, sale of assets, or operation of law.

30. Changes to These Terms

We may update, change, or replace these Terms from time to time by posting the updated version on our website. The "Last updated" date above indicates when these Terms were last revised. Unless otherwise required by law, updated Terms will be effective when posted.

Your continued use of the Services after updated Terms are posted means that you accept the updated Terms. If you do not agree to the updated Terms, you should stop using the Services.
